Privacy Policy

In plain words: We collect what we need to make your videos: your recording, the voice model made from it, and your contacts' names, companies and websites. We use it only to make and host your videos. We don't sell personal information, we don't use it to train our own AI models, and you can ask us to delete it at any time. If you received a Yabily video and want your page removed, see section 6.
1. Who we are
Yabily is operated by GrowWithAI, Inc., 603 E Fort King St. #48, Ocala, FL 34471 ("Yabily", "we", "us"). This policy covers yabily.com, the personal video pages we host, and our video production service. For our customers' own recordings and voice data, we are the business responsible for that information. For the contact lists our customers give us, we process that information on our customer's behalf and under their instructions.
2. What we collect
From customers
- Contact and account details: name, email, phone, company, job title, and anything you share when booking a call.
- Recordings and content: the video and audio you give us, scripts, logos and the links you want on your end screen.
- Voice model and lip-sync data: a synthetic voice model created from your recording, and facial movement data used to match lips to generated speech. See section 4.
- Consent records: your signed consent, your recorded consent statement and the date you gave them.
- Payment information: handled by our payment processor. We receive confirmation of payment and limited details such as the last four digits of your card, not your full card number.
- Communications: emails, messages and feedback you send us.
About our customers' contacts
- Information our customer provides: first name, and optionally last name, company, website address, how to pronounce the name, and the link the video should lead to.
- A screen capture of the contact's public company website, taken to show in the video.
From visitors to our website and video pages
- Contact form: the name, email, phone number, LinkedIn profile URL, role and message you enter on our contact page. We use them only to reply to you, and we store a one-way hash of your IP address to limit spam.
- Technical data: IP address, browser and device type, pages requested and time of request, collected in server and security logs by our hosting provider.
- Video page activity: when we enable viewing statistics for a customer, we record events such as page opens, play, how far the video was watched, and whether a link was clicked. We report these to the customer who sent the video. We use a random page ID rather than the viewer's name to record these events.
3. How we use it
- To produce, deliver and host the videos our customers order.
- To communicate with customers, schedule calls, provide support and take payment.
- To show customers how their videos perform, when that feature is turned on.
- To keep the Service secure, prevent misuse and enforce our Terms.
- To improve our own production process (for example, fixing a mispronounced name).
- To meet legal obligations.
We do not sell personal information, share it for cross-context behavioral advertising, or use customers' recordings, voices, faces or contact lists to train our own AI models. Where the law requires a legal basis (for example under GDPR), we rely on performance of our contract with you, your consent (for voice and face data), our legitimate interests in running and securing the Service, and legal obligations.
4. Voice and face data
A voice model and facial movement data may be considered biometric information in some places, including Illinois, Texas, Washington, Colorado, California, the EU and the UK. We treat them with extra care:
- We create them only after you give explicit written consent and a recorded consent statement.
- We use them only to produce videos you request.
- We never sell, lease or trade them, or disclose them except to the service providers that generate voice and lip-sync for us, or where required by law.
- We delete them when you ask, when you end the Service, or within the retention period set out in our Voice and Likeness Policy, whichever comes first.
We do not use face or voice data to identify people in general, and we never create voice models or lip-sync for the contacts who receive videos.
5. Who we share it with
We share personal information only with providers that help us run the Service, under contracts or terms that limit how they may use it, and only what each one needs:

We may also disclose information if required by law or legal process, to protect the rights and safety of people or of Yabily, or as part of a merger or sale of the business, in which case this policy will continue to apply to your information. We may update this list as our providers change.
6. If you received a Yabily video
Someone you know sent you a personal video made with Yabily. They provided your name, company and website address to us so we could make it. We used that information only to make and host their video for you; we don't contact you, add you to any list, or sell your information.
If you'd like your video page removed, or want to know what information we have about you, email privacy@yabily.com with the link to your video page. We will remove the page and delete your details from our production files, and let the sender know if appropriate. If you are a website owner and want a capture of your site removed, contact us the same way.
7. Cookies and analytics
Our website does not use advertising cookies. Our hosting provider may set strictly necessary cookies for security. When you open our booking pop-up, Calendly loads its scheduler and may set its own cookies under Calendly's privacy notice. If we add website analytics or video page statistics that use cookies or similar storage, we will update this policy and ask for consent where the law requires.
8. How long we keep it
- Voice model, source recordings and lip-sync data: as set out in our Voice and Likeness Policy, and never longer than needed for your videos.
- Contact lists and website captures: for as long as the customer's project is active, and deleted within 90 days after it ends or on request.
- Hosted video pages: 12 months after creation unless the customer asks for a different period or for earlier removal.
- Customer account, billing and consent records: for as long as you are a customer and afterwards as needed for tax, accounting, legal and dispute purposes (generally up to 7 years for financial records).
- Contact form messages: up to 2 years after your last message unless you become a customer, or deleted sooner on request.
- Technical logs: kept by our hosting provider for a limited period for security and troubleshooting.
Deleted data may remain in encrypted backups for a short period until those backups expire.
9. Your rights
Depending on where you live, you may have the right to:
- know what personal information we hold about you and get a copy;
- correct inaccurate information;
- delete your information;
- withdraw consent, including consent for voice and face data, at any time;
- object to or restrict certain processing;
- receive your information in a portable format;
- opt out of the sale or sharing of personal information (we do neither);
- not be treated differently for exercising these rights.
To make a request, email privacy@yabily.com. We will confirm who you are before acting and reply within the time the law requires (usually 30 to 45 days). You can use an authorized agent where the law allows. If our customer gave us your information, we may pass your request to them and help them respond. If you are in the EU or UK, you can also complain to your local data protection authority.
10. Security
We use encryption in transit, access controls, private storage for recordings and voice data, and providers with strong security practices. Only people who need access to produce your videos have it. No system is perfectly secure; if a breach affects your personal information, we will notify you as the law requires.
11. International transfers
We are based in the United States, and our providers may process data in the United States and other countries. Where we transfer personal information from the EU, UK or Switzerland, we rely on appropriate safeguards such as the Standard Contractual Clauses or the EU-US Data Privacy Framework where our provider participates in it.
12. Children
Yabily is a business service for adults. We do not knowingly collect information from anyone under 18, and our customers may not use it to contact children. If you believe a child's information was given to us, contact us and we will delete it.
13. Changes
We will post any changes to this policy here with a new effective date. If a change is material, we will tell customers by email before it takes effect.
