Terms of Service

In plain words: Yabily makes personal videos using your own face and voice, only with your recorded consent and only for you. You own your videos. You send them yourself, to people you have a real reason to contact, and you follow the rules that apply to your messages and your profession. Never use Yabily to make anyone appear to say something they did not agree to. This summary is for convenience; the full terms below are what apply.

1. Agreement

These Terms of Service ("Terms") are an agreement between you and GrowWithAI, Inc., doing business as Yabily ("Yabily", "we", "us"). They apply to yabily.com, the personal video pages we host, and the video production service we provide (together, the "Service"). By booking, paying for, or using the Service, you agree to these Terms, our Privacy Policy and our Voice and Likeness Policy. If you use the Service for a company, you confirm you can bind that company to these Terms, and "you" includes it.

2. The service

You provide one recording of yourself and a list of contacts. For each contact, we produce a personal video that typically includes: a short greeting with the contact's name, spoken in a voice generated from your recording and lip-synced to your face; a scrolling view of the contact's public website; your main message; and an end screen with a link you choose. We also produce a cover image and, where offered, a hosted video page for each contact.

During the founding pilot, the Service is done for you: our team builds the videos and delivers them to you. Features, formats and turnaround times may change as the Service develops. We may describe planned features, but only features we have delivered to you are part of what you buy.

Yabily creates a synthetic version of your voice and lip movements so that greetings sound and look like you. Because this is personal and, in some places, legally protected biometric information, these rules apply:

5. Your content and license to us

"Your Content" means the recordings, scripts, logos, contact lists, links and other material you give us. You keep all rights in Your Content. You grant us a limited, non-exclusive, worldwide license to use, copy, edit, process and host Your Content only as needed to provide the Service to you, including sending it to the service providers listed in our Privacy Policy. This license ends when Your Content is deleted, except for copies we must keep by law or that remain in routine backups until they expire.

You confirm that you have the rights to Your Content, that it does not infringe anyone else's rights, and that any music, logos or people (other than you) appearing in it are used with permission.

You may not use the Service, or any video it produces, to:

We may refuse to produce, take down, or stop hosting any video that we reasonably believe breaks these rules, and we may suspend or end the Service for serious or repeated violations.

8. AI-generated content and disclosure

Parts of every Yabily video are generated with artificial intelligence: the spoken greeting, the matching lip movement, and the assembled video. Some laws and platforms require that synthetic or AI-altered media be disclosed. You are responsible for any disclosure that applies to how and where you send your videos. On request, we can add a short disclosure to your video page or end screen. AI output can contain errors (for example, a mispronounced name); please review your videos before sending.

9. Third-party websites shown in videos

Videos may show a screen capture of your contact's publicly available website to show that you looked at their business. These captures are shown for identification and commentary only and do not imply that the website owner is affiliated with or endorses you or Yabily. All trademarks and content on those websites belong to their owners. If a website owner asks us to remove a capture of their site, we will remove the video page that shows it.

10. Video pages and hosting

Where we host a personal video page for a contact, it is placed at a hard-to-guess web address and is set so search engines do not index it. Anyone who has the link can view it, so share links only with their intended recipient. Unless we agree otherwise, we keep hosted video pages available for 12 months after they are created and may then remove them. You can ask us to remove any page sooner.

12. Ownership

Subject to payment, you own the final videos, cover images and pages we produce for you, apart from our templates, designs, software, end-screen layouts and any third-party material (such as website captures), which remain owned by us or their owners. You may use your videos for your own business outreach. We own the Service, the Yabily name and logo, and everything we build to provide it.

If you send us ideas or feedback, we may use them freely without paying you. We will not share your name, testimonial or videos publicly without your permission.

13. Third-party services

We rely on trusted providers for hosting, voice generation, lip-sync, scheduling and payments. They are listed in our Privacy Policy. Their availability and terms can affect the Service. We are not responsible for third-party websites or services you choose to use, such as LinkedIn, your email provider or your booking tool.

14. Ending the service

You can stop using the Service at any time by telling us. We may suspend or end the Service if you break these Terms, if required by law, or if we stop offering the Service, in which case we will refund any prepaid amount for videos we have not yet produced. When the Service ends, we delete your voice model and source recordings as described in the Voice and Likeness Policy. Sections 5 (for copies we keep by law), 7, 9, and 12 through 18 continue to apply after the Service ends.

15. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise any particular reply rate, meeting rate or business result from your videos, and we do not guarantee the Service will be uninterrupted or error-free.

16. Limitation of liability

To the fullest extent the law allows, Yabily will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose. Some jurisdictions do not allow these limits, so they may not fully apply to you.

17. Indemnity

You agree to defend and indemnify Yabily against claims, losses and costs (including reasonable legal fees) arising from Your Content, the people you choose to contact, how you send or use your videos, or your breach of these Terms or the law.

18. Governing law and disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Before filing any claim, both sides agree to try to resolve the dispute informally by contacting the other in writing and allowing 30 days to respond. Any claim that is not resolved will be brought in the state or federal courts located in Marion County, Florida, and both sides consent to those courts. Nothing here limits rights you have under consumer protection laws that cannot be waived.

19. Changes to these terms

We may update these Terms as the Service develops. We will post the new version here with a new effective date and, for material changes, tell you by email before they take effect. Continuing to use the Service after that means you accept the updated Terms.
